Transportation Investment Corporation’s (TI Corp) mandate is to provide procurement, delivery and commercial oversight of assigned major capital transportation projects. Currently, TI Corp is delivering the Pattullo Bridge Replacement Project, the Broadway Subway Project and the Kicking Horse Canyon Project – Phase 4. TI Corp is a subsidiary of the BC Transportation Finance Authority (BCTFA) and is governed by a board of directors.
TI Corp is committed to building capacity internally and, by extension, within the BC Public Service. The organization will apply robust and consistent controls and practices across the major transportation projects.
The Commercial Director will report directly to the Kicking Horse Canyon Project Phase 4 (KHCP4) Executive Project Director and will be responsible for the implementation of the Project Agreement with the Design-Build (DB) Contractor. The Commercial Director will manage the team responsible for Project Agreement implementation.
-Working closely with the Owner’s technical and construction management teams, leads the day-to-day oversight and administration of commercial terms within the contract between the Owner and Design Build (DB) Contractor.
-Applies extensive knowledge of the Project’s contractual requirements and commercial implications to provide advice to Project Team leadership and across the Project Team.
-Identifies and develops strategies to actively manage/mitigate commercial risks.
-Leads negotiations relating to change management, demonstration of entitlement, resolution of disputes and contract claims.
-Develops and implements procurement and contract management processes and procedures.
-Leads the technical team and Quantity Surveyors in the evaluation and quantification of changes.
-Manages the communications between TI Corp and the DB Contractor relating to commercial matters, including the drafting of project changes for review and approval.
-Ensures relevant records and logs are maintained and retained in accordance with the Project requirements.
-Maintains excellent relationships with key project partners to collaboratively achieve the Project goals.
-Monitors and reviews the DB Contractor’s progress and schedule.
-Supports the payment and certification processes.
-Attends key design/construction meetings, both internal and external, as required.
-Bachelor’s degree in law, civil engineering or construction management, or equivalent relevant experience.
-15+ years of progressive experience in the design, construction and contract administration of major infrastructure projects (preferably design-build transportation projects), including at least 7+ years of experience in the management and administration of commercial elements of project agreements.
-Experience with Provincial DB/DBF contracts within the Transportation sector would be considered an asset.
-Proven leadership in the oversight of commercial aspects of complex infrastructure projects. Exceptional relationship, communication, facilitation, negotiation, presentation and interpersonal skills.
-Understanding of cost estimates on construction projects.
-Representing companies in adjudication, mediation, and commercial negotiations.
-Understanding of contractual, commercial, and financial functions on major projects.
-Experience negotiating contracts.
-Claims management/dispute resolution experience on major projects of a complex nature, preferably in the Transportation sector.
-Thorough knowledge of contract language, change management, and legal requirements of contracts.
-Experience developing and implementing strategies for risk and opportunity management.
-Ability to liaise/co-ordinate internal and external legal counsel and experts.
-Successful completion of security screening will be required as a condition of employment with TI Corp.
