Job Title: Lands Survey Technician

Department: Lands & Membership Department

Status: Full-time Permanent

Position:

A Lands survey technician supports the registration of legal interests of the First Nations in the three lands registries administered by AANDC, and ensure that the statutory duties for the survey of reserve lands are carried out in accordance with the Indian Act and the Canada Lands Surveys Act

Requirements:

Ontario High School Diploma required

Certificate or diploma in Surveying an asset

Experience with land surveys and using land surveying equipment

Experience Reading, utilizing and interpreting design drawings and topographic maps Experience interpreting CAD computer applications an asset

Knowledge of GIS (Global Information System) Subject to a Criminal Reference Check

Valid Ontario Driver’s license (G) and access to a vehicle

Experience working with First Nations people would be an asset

Responsibilities:
Under the supervision of the Director of Operations, the duties and responsibilities of the Lands Survey Technician include, but are not limited to, the following:

  • Assist band members to figure out what type of survey they need
  • Assist band members to understand any problems (i.e. house lot and right-of-way locations) and identify any solutions
  • Figures out the logistical aspects of getting the work done
  • Advise band members if any of the work will be subcontracted
  • Coordinate the hire of Canada Lands Surveyor to survey the land on site and check the draft survey plan for correctness
  • Conduct engineering surveys using survey instruments for establishing legal survey boundaries.
  • Review field work performed and notes taken to ensure the accuracy and completeness of work
  • Provide technical survey assistance for First Nation members, and departments, lessees and permits to solve specific land boundary problems
  • Maintain and authorize the use of survey instruments
  • Create new 911 numbers addresses for new building sites Locate survey markers for property owners
  • Prepare text for band allotment to qualified band members Mark out housing lots and cottage lots when required

Research

  • Obtain background information on the land
  • Reviews existing survey information from the Canada Lands Survey Records Researches the appropriate land registry for existing rights in property
  • Development and Agreements knowledge
  • Prepare documentation in matters pertaining to the conveyance of Individual Land Holdings.
  • Assess and evaluate land transfer proposals to ensure they are consistent with Walpole Island First Nation and Federal Government legislation, regulations, policies and procedures
  • Prepare land transfer sketches for the purpose of identifying transferred boundary areas
  • Conduct title searches to ascertain the status of the land title and determine encumbrances using INAC’s Indian Land Registry System
  • Determine correct land descriptions of land transfers. Ensure they meet the requirements outlined in the Interdepartmental Agreement
  • Ensure land transfers have appropriate form of access and documentation related therto
  • Ensure correct form of lawful possession – Joint Tenancy or Tenancy in Common and documentation related thereto
  • Instruct and advice Council and First Nation members in the process and procedures in transferring land titles
  • Prepare land transfers, right of way agreements, land sketches and other documentation and prepare correspondence related thereto:
  • Obtain all required signatures and affidavits to Individual Land Holding documentation
  • Review Land Transfers, Right of Ways, Land Transfer Sketches and other Individual Land Holding documentation executed by applicants for accuracy and completeness so they meet all requirements outlined in the Indian Land Registry Manual
  • Complete INAC checklist of each document prepared, for a permanent check that all procedures have been followed in the drafting Individual Land Holding documents
  • Advise applicable Band staff (Lands staff and Finance Staff) of changes affecting change of Land ownership. Copy of Member to be attached on file.
  • Ensure the approval and registration of all Land Transfers, Right of Ways and other Individual Land Holding documentation. Record all transactions in the Document Tracking System and the Pending File
  • Monitor the status of all Individual Land Holding transactions
  • Provide guidance in the maintenance of individual land holding records related to Band lands, locate holdings and estate interests
  • Record on file client interviews and telephone conversations relevant in providing background information to the transaction
  • Complete Checklist of each document prepared, for a permanent check that all procedures have been followed in the distribution of registered documents
  • Record all registered Land Transfers, Right of Ways and other ILH documentation in the Document Tracking System
  • Assist in the policy and land procedure development
  • Assist the Lands & Membership Administrator and Lands Assistant in daily lands management responsibilities
